The Philippine closing process touches five government agencies — BIR, LRA, the LGU Treasurer, the LGU Assessor, and (for foreign retirees) the PRA. Stage 03 · Tax Filing

Bureau of Internal Revenue · BIR

Tax forms required to file Capital Gains Tax (CGT) and Documentary Stamp Tax (DST), and to obtain the eCAR — the Electronic Certificate Authorizing Registration that gates Registry of Deeds registration.

  • Form 1706Capital Gains Tax Return — One-Time Transactions

    Filed by the Seller within 30 days of notarization of the Deed of Absolute Sale. Computes the 6% CGT on the higher of selling price, BIR zonal value, or assessor's FMV.

  • Form 2000-OTDocumentary Stamp Tax Declaration — One-Time

    Filed by the Buyer by the 5th day of the month following notarization. Computes the 1.5% DST on the same tax base used for CGT. Required before BIR will issue the eCAR.

  • Form 1606Withholding Tax Remittance — Sale of Real Property

    Used in lieu of Form 1706 when the property is classified as an ordinary asset (held as part of the seller's trade or business). The withholding agent is the Buyer.

Land Registration Authority · LRA

Standardized deed and information forms used at the Registry of Deeds. The Mandatory Registration Information (MRI) forms below were made required under LRA Circular 17-2021.

  • RD DirectoryRegistry of Deeds Locator

    Locator for the Registry of Deeds having jurisdiction over the property. Each city and province has its own RD. The Anywhere-to-Anywhere (A2A) program now allows requests at any computerized RD nationwide.

Stage 04 · Local Tax

Local Government Units · LGUs

Forms vary by city or municipality. The two most-needed are the Real Property Tax Clearance from the Treasurer's Office and the new Tax Declaration from the Assessor's Office. Use the DILG directory to find the correct LGU office for your property.

  • RPT ClearanceReal Property Tax Clearance (Treasurer's Office)

    Issued by the LGU Treasurer's Office showing the Seller has no RPT arrears. Required before the BIR will issue the eCAR. Each city or municipality has its own form.

  • New Tax DecApplication for New Tax Declaration (Assessor's Office)

    Filed at the LGU Assessor's Office after the new title issues from the Registry of Deeds. The Assessor cancels the Seller's Tax Declaration and issues a new one in the Buyer's name. The final post-closing step.

Philippine Retirement Authority · PRA

SRRV application forms for foreign retirees who want to convert their qualifying deposit into a Philippine real estate investment. Under the September 2025 restructure, the minimum age has been lowered to 40, and only Classic and Courtesy streams remain.

    Used to add a spouse or unmarried child under 21 to a Principal's SRRV application. The Principal may bring one spouse and unmarried children without additional deposit; additional children require US$15,000 each.

  • DFAApostille Service — Department of Foreign Affairs

    The Philippines is a party to the 1961 Hague Apostille Convention. Documents executed abroad — SPAs, foreign deeds, foreign police clearances for SRRV — must be apostilled in the country of origin. The DFA issues apostilles for Philippine-executed documents needed abroad.
